Welcome to grooveacademy.ca (“Website”). By accessing or using our Website, you agree to be bound by these Terms and Conditions (“Terms”). Please read these Terms carefully before using our services. If you do not agree to these Terms, you may not use the Website.

1. Purpose of the Website

grooveacademy.ca is an online platform dedicated to music education, specifically for:

• Our “Teacher Training Program“.
• The Student Resource Center.
• Free Music Lessons.
• Booking private online lessons with instructors.

Eligibility

A. General Eligibility
Our music lessons are available to students of all ages and skill levels. By enrolling in lessons, you confirm that you (or your child) meet the following requirements:

• Students under the age of 18 must have a parent or legal guardian register on their behalf and agree to these Terms and Conditions.
• Students must have access to the necessary instrument(s) and materials required for their selected lessons.

B. Online Lessons

• Students must have a stable internet connection, a compatible device (computer, tablet, or smartphone), and access to a webcam and microphone.
• A quiet and distraction-free environment is recommended for optimal learning.

C. In-Home Lessons

• A parent, guardian, or responsible adult (18+) must be present during In-home lessons for students under the age of 18.

The lesson space must be a safe, clean, and appropriate environment for learning.

D. In-Studio Lessons

• Students must adhere to studio policies regarding scheduling, cancellations, and behavior while on the premises.

We reserve the right to decline or discontinue lessons if a student fails to meet these eligibility requirements or engages in conduct that disrupts the learning environment.

3. Account Registration

To access certain features of the Website, you may need to register for an account. When registering:

• Provide accurate and complete information.
• Maintain the confidentiality of your login credentials.
• Notify us immediately of unauthorized access to your account.

You are responsible for all activities that occur under your account.

4. Use of Services

You agree to use the Website and its services solely for lawful purposes related to music education. Prohibited uses include but are not limited to:

• Impersonating others or providing false information.
• Using the Website for any commercial purposes other than those explicitly authorized by grooveacademy.ca.
• Engaging in any activity that disrupts or interferes with the Website’s operation.

5. Private Music Lessons

If you book private online, In-home or In-studio lessons through the Website:

• Lessons are conducted by independent instructors verified and vetted by grooveacademy.ca.
• Cancellations must be made at least 24 hours in advance in order to receive a make-up lesson
• Please refer to all policies, and Terms & Conditions in your sign-up form and viewable in your parent/student portal.

6. Teacher Training Program

Participation in the “Teacher Training Program“ is subject to additional eligibility and compliance requirements. grooveacademy.ca reserves the right to update program content and policies at any time.

7. Content Ownership

All content available on the Website, including but not limited to text, images, videos, and resources, is the property of grooveacademy.ca or its licensors and is protected by intellectual property laws. Users may not reproduce, distribute, or modify Website content without explicit permission.

8. User-Generated Content

If you submit or upload any content to the Website (e.g., reviews, comments, or videos):

• You grant grooveacademy.ca a non-exclusive, royalty-free, worldwide license to use, display, and distribute the content.
• You warrant that the content does not infringe on the rights of others or violate applicable laws.

9. Payment Terms

Payments for private lessons or other paid services/merchandise must be made through the payment methods provided on the Website. All fees are non-refundable unless otherwise specified.  All prices listed on our website are in CAD unless otherwise stated.  We reserve the right to modify pricing at any time without prior notice.  Payment must be made in full before services or products are provided.  Recurring services (such as lesson subscriptions) are billed and charged on the 1st of every month.  Depending on lesson types, we have a flat rate fee and pro-rated fees.  Customers are responsible for any applicable taxes, duties, or fees imposed by regulatory authorities.  All music lesson policies, and Terms & Conditions, are clearly explained in our sign-up form and viewable in your Parent/Student portal.

10. Disclaimers and Limitations of Liability

• The Website and its services are provided “as is” without warranties of any kind, express or implied.
• grooveacademy.ca is not liable for any damages arising from the use of the Website, including but not limited to lesson quality, availability of resources, or unauthorized access to your account.

11. Termination

We reserve the right to terminate or suspend your access to the Website at our discretion, without notice, for conduct that violates these Terms or is otherwise harmful to grooveacademy.ca.

12. Changes to Terms

grooveacademy.ca may update these Terms at any time. Continued use of the Website after updates constitutes acceptance of the new Terms.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Manitoba, Canada, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms, the website, or the services provided shall be subject to the exclusive jurisdiction of the courts of Manitoba, Canada. By using this website, you agree to submit to the personal jurisdiction of these courts for the purpose of litigating any such disputes.
